1.1. The PalmReading website available at this domain and content available via PalmReading or our emails ("Content") are operated by PalmReading. Your access and use of the Service constitutes your agreement to be bound by these Terms and Conditions of Use (the "Terms"), which establishes a legally binding contractual relationship between you and the Company.

4.1. The Service may contain links to third-party websites, advertisements, or services that are not owned or controlled by PalmReading. We assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.

4.2. You acknowledge and agree that PalmReading shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods, or services available on or through any such third-party websites or services.

5. Fees and Payment

5.1. Certain features of the Service may require a paid subscription. When you purchase a subscription, you agree to pay the applicable fees as described at the time of purchase.

5.2. Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date. You may cancel your subscription at any time through your account settings or by contacting our support team.

5.3. Free trials may be offered from time to time. If you do not cancel before the trial period ends, you will be automatically charged the applicable subscription fee. You will only be eligible for one free trial per account.

5.4. All payments are processed through secure third-party payment processors. We do not store your credit card information on our servers.

6. User Representations and Restrictions

By using the Service, you represent and warrant that:

a) You are at least 18 years of age or the age of legal majority in your jurisdiction;

b) You will not use the Service for any illegal or unauthorized purpose;

c) You will not attempt to interfere with or disrupt the integrity or performance of the Service;

7. User Content & Palm Images

7.1. You retain ownership of any palm images or other content you submit to the Service. By submitting content, you grant PalmReading a limited license to use such content solely for the purpose of providing you with the Service (generating your palm reading).

7.2. Palm images uploaded for readings are used exclusively to generate your personalized reading and are deleted from our servers after the reading is created. We do not use palm images as biometric data or for any purpose other than generating your reading.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. PALMREADING SPECIFICALLY DISCLAIMS ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PALMREADING SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES. IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless PalmReading and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

11. Governing Law & Dispute Resolution

11.1. These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles.

11.2. Any dispute arising from or relating to the subject matter of these Terms shall be finally settled by binding arbitration. The arbitration shall be conducted on a confidential basis. You agree that any arbitration shall be conducted on an individual basis and not in a class, consolidated, or representative action.

12. Miscellaneous

12.1. If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.

12.2. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

12.3. These Terms constitute the entire agreement between you and PalmReading regarding the Service and supersede all prior agreements and understandings.
